End User License Agreement (EULA)

This End User License Agreement ("Agreement") is a binding legal agreement between you ("User" or "You") and Peter-Donnell Boynton (the "App Creator") and the United Church of Jesus Christ (collectively, the "Providers") governing your use of this mobile application (the "App").

By downloading, installing, or using the App, you acknowledge that you have read, understood, and agree to be bound by the terms of this Agreement. If you do not agree to these terms, do not download, install, or use the App.

1. License Grant

The Providers grant you a revocable, non-exclusive, non-transferable, limited right to install and use the App on a mobile device owned or controlled by you, strictly in accordance with the terms and conditions of this Agreement, the Apple Media Services Terms and Conditions, and the Google Play Terms of Service.

2. User-Generated Content (UGC) and Acceptable Use

To ensure a safe and welcoming environment for all users, this App has a strict, zero-tolerance policy regarding objectionable content and abusive behavior. "User-Generated Content" includes any text, images, photos, audio, video, or other materials uploaded, posted, or shared by users within the App.

Prohibited Content

You agree that you will not submit, post, or share any User-Generated Content that is:

Offensive or Objectionable: Content that is defamatory, discriminatory, highly offensive, promoting violence or hatred against individuals or groups, or containing profanity.
Sexually Explicit: Pornographic, sexually explicit, or overly suggestive materials.
Harassing: Content intended to bully, threaten, intimidate, or harass other users.
Illegal: Content that promotes illegal acts, child endangerment, or violates any local, state, national, or international law.
Infringing: Content that violates the intellectual property rights, privacy rights, or publicity rights of any third party.

3. Moderation, Reporting, and Blocking

To comply with Apple and Google safety guidelines, the App includes built-in mechanisms to protect users:

Filtering: The App utilizes mechanisms to filter objectionable material before it is published.
Reporting: Users can flag and report offensive content or abusive users directly within the App.
Blocking: Users have the ability to block other users, preventing further interaction.
Enforcement & 24-Hour Response: The Providers actively monitor reports. We will review all reported content and users within 24 hours of submission.
Penalties: Any user found to be posting objectionable content or engaging in abusive behavior will have their content immediately removed and their account permanently suspended or terminated without prior notice.

4. Privacy and Data Collection

Your privacy is important to us. By using the App, you consent to the collection, use, and sharing of your information as necessary to operate the App and as outlined in our Privacy Policy.

Data Usage: We collect data solely to provide app functionality, improve user experience, and ensure security.
Account Deletion: In accordance with Apple and Google requirements, you may request the complete deletion of your account and associated personal data at any time via the in-app settings or by contacting the Providers directly.

5. Disclaimer of Warranties

The App is provided to you "AS IS" and "AS AVAILABLE" without warranty of any kind. To the maximum extent permitted by applicable law, the Providers expressly disclaim all warranties, whether express, implied, or statutory, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Apple Inc. and Google LLC have no obligation whatsoever to furnish any maintenance and support services with respect to the App.

6. Limitation of Liability and Hold Harmless

To the maximum extent permitted by applicable law, in no event shall the App Creator (Peter-Donnell Boynton), the United Church of Jesus Christ, nor their respective directors, officers, employees, agents, affiliates, or volunteers be liable for any personal injury, property damage, or any incidental, special, indirect, or consequential damages whatsoever arising out of or related to your use of or inability to use the App, or your interaction with other users or User-Generated Content within the App.

Hold Harmless Agreement:

By using this App, you agree to indemnify, defend, and hold harmless Peter-Donnell Boynton and the United Church of Jesus Christ from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney's fees) arising from:

Your use of and access to the App.
Your violation of any term of this Agreement.
Your violation of any third-party right, including without limitation any copyright, property, or privacy right.
Any claim that your User-Generated Content caused damage to a third party.

7. Third-Party Beneficiaries

You acknowledge and agree that Apple Inc., Apple's subsidiaries, and Google LLC are third-party beneficiaries of this EULA. Upon your acceptance of this Agreement, Apple and Google will have the right (and will be deemed to have accepted the right) to enforce this EULA against you as a third-party beneficiary thereof.

8. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the jurisdiction in which the United Church of Jesus Christ is headquartered, excluding its conflicts of law rules.
